FML!!! Anybody smart here know the law?

Im in a custody battle with my childs father. It's still in the courts. I recently started seeing someone, and just found out he was charged with ault a few years ago. Would this give my ex grounds to take my child if her and I were to move in with my new boyfriend? He's going to look into a pardon.
